Background
Hampton Lodge is an assisted living development comprised of 39 Leasehold flats, all sharing a Residents Lounge, Laundry Room and Communal Car Park. The property was constructed in 2006 by Churchill Retirement Living, and managed by an agent owned by the Freeholder. The agent had managed the development since it was built, but the Leaseholders always felt excluded from decision-making and wanted more control over the ever rising project expenditure and maintenance charges.
The Problem
- Leaseholders had limited say in day-to-day management.
- Concerns increased over transparency and responsiveness.
- Contractors selected by the agent were far more costly than those nominated by Leaseholder.
The Solution
- Leaseholders engaged Diamond Managing Agents Limited (DMA) to guide them through the Right To Manage (RTM) process.
- A formal RTM Claim application was made, and DMA prepared all the documents and notices to serve to the Freeholder.
- Despite strong resistance from the Freeholder, the RTM was granted, allowing Leaseholders to manage their block independently and control their own destiny.
The Outcome
- Leaseholders gained full control over service contracts, repairs, and budgeting.
- Regular meetings are held by the Leaseholders with the RTM company directors, and with DMA to ensure collaborative decision-making.
- The property has seen improved responsiveness, better cost control, and stronger community engagement.
Key Takeaways for Leaseholders
- RTM empowers Leaseholders in all types of developments.
- Legal guidance and a structured approach are essential to achieve RTM. DMA is fluent in this approach.
- The maintenance of the property is of a high standard, and at a greatly reduced cost.
